Terms of service

1. Scope of services

ovgamma provides managed AI lead qualification, automated voice and text outreach in several languages, and performance marketing infrastructure. All platform features and managed services are provided in Dubai, UAE, by the licensed operator (see the licensed operator details in section 6).

2. Customer responsibilities and acceptable use

• Data and consent. Customers are solely responsible for making sure that all lead data they upload, provide or capture through ovgamma carries explicit, verifiable opt-in consent for commercial outreach, as required by UAE federal law and applicable international data privacy standards.
• Lawful use. Customers must not use ovgamma for unauthorised telemarketing, deceptive outreach, spam or fraud.
• Account credentials. Customers are responsible for keeping their logins, API keys and admin access linked to their service agreement safe.

3. Billing, fees and overages

• Subscription and service charges. Platform access fees, retainer charges and base usage allowances are billed in advance on a recurring monthly or annual schedule, as set out in the relevant Service Agreement or Order Form. Annual plans are paid upfront for 12 months; monthly plans are paid upfront each month.
• Setup fee. A one-time setup fee applies. It is quoted on a call based on the complexity of your setup and confirmed in your Order Form before any work starts.
• Free trial. Where offered, the 7-day free trial of the Web AI Agent is free, needs no card and has a usage limit. Nothing is charged for it; when it ends, the agent pauses unless you choose a paid plan.
• Usage and overages. Usage beyond your plan’s allowance (for example extra call minutes, AI processing or lead verification) is bought as top-up packs at the prices on our pricing page, or billed at the end of each billing cycle at the rates set out in your Service Agreement or Order Form.
• VAT. Where UAE tax law requires it, 5% Value Added Tax (VAT) is added to fees and itemised on invoices.
• Third-party charges. Charges from other providers, such as Meta’s WhatsApp conversation fees, are billed by that provider and are not included in our prices.

4. Cancellations, renewals and refunds

• Cancellation notice. Customers can cancel at any time by giving at least thirty (30) calendar days’ written notice (an email to info@ovgamma.com is enough). Cancellation takes effect at the end of the billing period in which the notice period ends; the service continues until then and nothing is charged after it.
• Plan changes. Upgrades apply straight away. Downgrades apply from the next billing cycle.
• Refunds. The setup fee is non-refundable once setup work has started. Custom AI agent onboarding costs and usage already consumed are non-refundable. Prepaid retainer balances or unused service time after cancellation are non-refundable unless agreed otherwise in writing.

5. AI limitations, disclaimers and operating rules

• Nature of AI. ovgamma uses automated machine learning and generative AI models for real-time voice conversations and lead evaluation. Although tuned for accuracy, AI systems can occasionally produce unexpected answers or delays.
• AI disclosure. Our automated voice and text agents are set up to tell contacts they are an AI at the start of a conversation, and never to claim to be human. Customers must not configure or use them to do otherwise.
• No revenue or conversion guarantees. ovgamma is a technology and marketing management service. It does not guarantee any sales conversion rate, revenue target or financial return.
• No brokerage activity. ovgamma operates only as a lead qualification and marketing platform. ovgamma and its operating entity do not carry out real estate transactions, offer financial brokerage services, or sign binding commercial contracts on behalf of others.

6. Government and regulatory disclaimers

Commercial trade licences issued by the Dubai Department of Economy and Tourism (DET) certify legal authorisation to carry out marketing operations in the United Arab Emirates. They are not a government endorsement, a validation of our software, or an official guarantee of platform performance.

7. Dispute resolution and governing law

• Governing law. These terms are governed by, interpreted and enforced under the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.
• Jurisdiction. Any dispute, claim or legal action arising from or relating to these terms is subject to the exclusive jurisdiction of the Courts of Dubai.
